are happy that your next family member is coming from Smalltown,
and welcome you to our Smalltown family. If you reserved
your puppy in advance of 8 weeks and it is to be shipped, you are receiving two
copies of our contract for your review. It is very important for you to do
this, and understand what is expected from breeder and buyer alike. In
the case of a puppy that is shipped, please read and complete your portion of
the contract that says "FOR
BREEDER" and send it back. You will retain the copy that says "FOR BUYER", and receive a separate shot record with your pup when it is shipped. Your Puppy is guaranteed to
be in good health at the time of purchase and upon leaving us. Your puppy MUST
see a veterinarian within 72 hours of leaving our home,
(date)____________(time)__________We pride ourselves on breeding happy, healthy
pups registered with AKC (American Kennel Club). If pup does not see a vet
within this timeframe, all implied or written guarantees are void. In the event of an
early death a necropsy MUST be performed on the puppy within 12 hrs from time
of death, including a full toxicology and blood panel with all results to be
faxed to our vet upon completion of the necropsy. Fax numbers will be provided
to attending veterinarian at time of incident. If early death is indeed proven
to be the breeders fault, a replacement puppy will be provided. In order to be covered by our guarantee, this
procedure must be followed to the letter.
Failure to do so voids all guarantees. The following accepted
vaccinations and wormings were given on the dates
listed, we use Progard 5 (Canine Distemper,
Adenovirus Type 2, I acknowledge I have read
and understood the above (buyers initials)_________ The following is our Sales Agreement for your Smalltown
puppy. This is a legal contract,
please read carefully before signing. For the purpose of this contract, the following terms apply: “BUYER” shall herein be
defined as: a person or person’s purchasing a puppy.

this puppy dappled at birth YES___ NO___ ~ IMPORTANT: If a pup is dappled at birth, but does not appear as an
adult to be dappled, it is still dapple. If it is purchased as breedable, and is bred to a dapple, the resulting puppies
could well be double dapple and suffer serious health problems. We do not
recommend that you do this. If Smalltown learns that
a dog of our breeding has purposely been used to produce double dapples, we
will immediately remove said dog from your possession with no monies
refunded. I acknowledge I have read and understood the above (buyers initials)_________ *Smalltown does NOT guarantee adult size, color or hair coat
I,___________________________________(purchaser
name) acknowledge that I have 3 days (72 hours) from the date of purchase
and pickup to get the puppy vet checked in order to make the 3 year genetic
guarantee valid. If the puppy is not vet checked within this time period, sale
is FINAL. If
your veterinarian finds that the puppy is not acceptable on his/her initial
visit, a letter must be provided by the Veterinarian and validated by this
breeder’s veterinarian within as soon as one becomes available or a refund will
be honored for the purchase price (less any fees, such as Pay Pal & the
non-refundable deposit) The puppy must be returned to breeder at buyer’s expense
with 48 hours of examination or the sale is FINAL. In the case of shipping,
puppy must be returned to breeder within one week. In NO OTHER CASE shall purchase price or
non-refundable deposit be returned. ALSO-
if a pup is purchased show potential/breedable, and a
genetic issue is found WITHIN 2 years (not caused by diet or environment),
monies will be refunded down to pet price if the animal has not been bred and a
vet proof of alteration is provided to the breeder. If the animal has been
bred, this offer is void. PLEASE,
it is vital that you don’t bring your puppy into contact with other dogs, or
feces/urine during this time (before the final round of shots). Remember, a
puppy’s immune system is not a finished product at this stage of life. Many
things can be transferred dog to dog, or even by sniffing feces/urine. Parvovirus, Leptospirosis, Parainfluenza, Bordetella (Kennel
Cough) to name a few. Smalltown
provides a 3 year health guarantee for life threatening genetic disorders that
would affect the dogs ability to function as a pet. In
the case that a genetic defect should appear, upon verification by a qualified
veterinarian and consultation with my veterinarian, I shall replace the dog with one of equal or
greater value (with the difference owed to the breeder), whichever the purchaser
prefers. The puppy must be returned, at buyer’s expense, along with
registration papers. In NO case shall a dog be destroyed without notifying Smalltown first! Failure to comply with this provision
voids all guarantees and you will forfeit any replacement. All puppies on full registration must have
our kennel name, Smalltown, in their
registered names. We are a kennel
breeding for the betterment of the breed. We put just as much work and effort
into producing your lifetime companion as we do into our show dogs. For that
reason, we would like to be given due credit for producing our exceptional
Dachshunds. TITLE/DEGREE
REFUNDS* (cannot exceed purchase price) Puppies
are sold on two levels. One, as breedable
or as show potential. The price on these puppies is typically slightly
higher than then puppies sold as pets or limited, as limited registration
puppies are reduced as a consideration by the Breeder to the Buyer. We DO NOT
guarantee our puppies to be show quality, only show potential. Structure or
color can and will change over time, perhaps making these promising youngsters
unsuitable for the ring. Limited, pet or reduced puppies absolutely cannot be
used for breeding, as these puppies may have ring (color, structure) faults or
other hidden faults that in no way affect the ability of these animals to lead
normal, productive lives as pets. Pets must be spayed/neutered
as they have been reduced in price as a consideration to the buyer wanting
only a pet, not a breeder. A spay/neuter certificate must be sent to
the breeder by the time the dog reaches 12 months of age, failure to do so will
result in immediate transfer of ownership back to the breeder. If a pet quality
animal is found to be used for breeding, any puppies resulting from such an
action will be fined $500 per offspring.
I acknowledge I have read and understood the above (buyers initials)_________ *Show Quality/Show Potential Show
Quality/Potential is
to be shown by owner or owner’s agent to
complete a championship. Show Quality/Potential may also be used for breeding after
Companion Dog titles or other such titles or certifications have been earned.
(This does not include CGC). Show
Quality/Potential animals ARE NOT to be used just for breeding purposes without
a title. If determined by Owner and
Breeder such animal just cannot complete a title for whatever reason, Breeder
will consider the animal to be used for breeding or refund to pet price or
replace from next available litter as determined by Breeder, Breeder has final
say in this issue. If Buyer wants a
replacement and chooses to keep original animal, it must be spayed/neutered and
a certificate must be supplied to breeder.
A replacement will be supplied on the next available show potential
litter. Any and all requests must be
made in writing with no exceptions or contracted is violated. Amendment to contract must be made. All show quality bitches are to be bred back
to a champion owned by WHAT
WE DO NOT COVER: If,
at any time in the pup’s life, you find you cannot keep said pup, you agree to
notify Smalltown Dachs. We
will attempt to re-home the dog, by providing names
and contact information of potential homes.
In the case that a Smalltown dog is
surrendered to us, we will re-home the dog as a pet or
retain the dog, at our discretion, but there will be no monies refunded. You
agree to never sell one of our dogs to a Puppy Mill or to other large
commercial breeders (especially those with multiple {more than 2} breeds), pet
shops or other brokers. If this clause is breached, , Buyer agrees they will
be subject to legal action and damages up to $5000 for damaging the reputation
of Smalltown and Jennifer J. Thon and immediate
ownership of the animal in question will be forfeited back to Small Town with
no compensation to the owner. If,
by 8 weeks of age, a reserved or partially paid for pup is not picked up, all
monies paid on pup will be forfeited, unless other arrangements have been made
in advance. If previous arrangements have not been made, puppy will be back up
for sale two days after the pickup date. Final payments will be accepted in the
form of cash only. Any and all court proceedings (if deemed necessary) must
take place within the jurisdiction of ------------------------------------------------------------------------------------------------- -------------------------------------------------------------------------------------------------- Notary signature and seal for out of state purchases_______________________ NOTE: If you wish to have Smalltown resell your dog: We cannot give purchase price when you return the dog, but if you
wish to resale the dog and have it stay here at a rate of $7 a day for adults
or $10 a day for puppies,
you will be reimbursed for the amount of the resale when it
occurs minus any fees for advertising, time, etc that we invest only after the
dog has been paid for by another buyer. |
